Estate Administration and Accounting -

We provide legal counsel to fiduciaries of wills and trusts to assist them in the performance of their duties. Executors are assisted in the collection of the decedent's assets, post-mortem planning, the preparation of the appropriate income tax and estate tax returns and the final accounting of their performance. Formal or informal accounting proceedings are instituted to conclude the administration of the estate or trust and to release the fiduciary from further liability.

Estate Litigation -

On occasion, disputes arise in the administration of estates. Questions may be raised about the proper execution of a decedent's will or other factors that might affect its validity. Claims may need to be made against the decedent's estate. Beneficiaries may have objections to the manner in which an estate has been administered. We can represent parties in their claims against estates in these kinds of proceedings.

Matrimonial/Estate Planning -

Divorce, separation and antenuptial agreements have major effects on the estate planning of the spouses involved. The consequences should be understood by the affected parties at the earliest possible time. We can serve as consultant to matrimonial attorneys in the negotiation of separation agreements, divorce decrees, and antenuptial agreements, so that their clients can get the most favorable tax and estate planning benefits from the agreement. We can also provide the estate planning services to their clients supplementary to the marital proceeding, so that their clients' estate plans and property ownership reflect the new marital status.

Representation of out-of-town beneficiaries -

Out-of-town beneficiaries of estates can find themselves at a disadvantage in the representation of their interests during the probate and administration of estates. Often, one can feel remote from the proceedings, unaware of the status of the estate administration, whether assets are being properly invested or tax returns filed in a timely manner and, generally, whether one's interests are being considered. We are available to such an out-of-town beneficiary to monitor the progress of an estate's administration, to keep in touch with the executor or administrator, and to represent the beneficiaries in any accounting proceeding. Many times, assets will pass directly from the decedent to a beneficiary which will not be involved in the probate of the decedent's will. These assets need to be located and transferred to the beneficiary. We can assist in this process, as well. We also welcome the opportunity to work with out-of-town counsel in protecting the interests of their clients in this area.
